NUANS Name Search Reports, Province Specific Name Search Reports, Preliminary Name Search Reports and Trade Mark NUANS Searches
Nuans Name Search Reports are required for the registration of an incorporated company in the federal, Alberta, Ontario, New Brunswick, Manitoba, Nova Scotia, and Prince Edward Island jurisdictions and for the registration of business names, sole proprietorships, partnerships and extra-provincial registrations in most provinces and territories. The other provinces have their own specific forms of name search reports which are required for some or all of these types of registrations.
Nuans name searches are not required for the registration of Ontario or Alberta business names, partnerships or sole proprietorships however it is advisable to do a preliminary name search to ensure your name is not taken since the onus is on you to ensure that the name is not being used by another business.
If you are planning on incorporating a federal company it is advisable to obtain a Name Decision prior to incorporating to help ensure your name is available. Be aware that it is very difficult to obtain an acceptance of a federal name.
There is no guarantee that a preliminary name search will determine the availability of a name however the odds of acceptance are increased by 99% when performed by an experienced search house. When you order a name search report a pre-clearance of the name will be done within the same day you order it and in most cases immediately. Depending on the difficulty in obtaining a name that is available, the process can take a few days working together to find a name that works. Once a clear name has been determined the name search report will be ordered immediately. Some reports are available in 20 minutes while others take a few days.
